Roberto Biagini S.R.L. (hereinafter also referred to as "Roberto Biagini" or "the Company" or "the Data Controller") takes the protection of your personal data very seriously. The Company's goal is to ensure the protection of users' personal data at all times.

This privacy policy concerns the use of this website (www.robertobiagini.it, hereinafter also referred to as the "Website") managed by Roberto Biagini S.R.L., as well as the use of all services offered through it. Therefore, users are invited to carefully read this Policy on the processing of personal data to find out what data is collected and for what purposes it is processed.

1. Reasons for the Policy and Data Controller

Roberto Biagini S.R.L. informs you that it is the Data Controller - pursuant to Articles 4, no. 7 and 24 of EU Regulation 2016/679 "General Data Protection Regulation" (hereinafter also referred to as "Regulation" or "GDPR") - of the Personal Data you provide to Roberto Biagini S.R.L. through this Website. In the latter circumstances, this policy is supplementary to any other information received.

We also inform you that your Personal Data will be processed in compliance with current European privacy legislation (Regulation (EU) 2016/679), as well as specific local regulations applicable to processing outside the European Union.

2. Type and source of data

The Personal Data that Roberto Biagini will collect and retain depending on the specific purposes indicated below includes, for example, personal information such as title, first and last name, date of birth, country, language; contact information such as postal address and email address, telephone number and, for the purpose of purchasing, payment information such as credit card or other payment method (hereinafter also collectively referred to as "the Data").

Roberto Biagini will process the Personal Data that you directly and knowingly provide through this Website when placing your online purchase order and/or registering on the Website by creating an account and/or subscribing to Roberto Biagini's newsletter service and/or submitting a request to our Customer Service, as well as any data provided by filling out customer forms at a Roberto Biagini group boutique or by participating in events organized by the same.

When registering an account on the Website, the user is required to provide personal information, such as title, first and last name, country, language, date of birth, email address, and phone number. The user is also required to choose a password for their account.

When the Company is contacted by a user, for example by sending an email, the message received is stored for the purpose of responding to questions, processing requests, and improving the services offered.

Every time the user accesses the Website, certain data is also collected automatically, such as IP address, browser type and version, operating system and platform used, through so-called "cookies." Cookies are a particular type of data, transferred and stored on the user's hard disk through the browser used by the latter, which allows the company to create mechanisms useful for authenticating access, storing selected navigation settings, and customizing the Website based on the personal needs of users. Users can disable cookies through their browser settings, but it should be noted that doing so may make it impossible to use some of the Website's services.

If the user provides personal data of third parties, he/she must ensure that these individuals are informed and have authorized the processing of their data as described in this Policy.

3. Methods of processing, purposes of data processing, and nature of provision

The Company informs you that it will process your Personal Data for the following purposes, either manually and/or with the aid of computerized or telematic means.

Personal Data will be collected to manage the relationship between you and Roberto Biagini S.R.L. and to respond to or satisfy any of your requests, as well as to follow up on your online purchase order through the website www.robertobiagini.it and therefore to carry out all order management activities, including administrative management of the contract, product shipping, accounting, fraud prevention, management of any disputes, communications with the user for any problems relating to order management or subsequent requests relating to the order, as well as to comply with all obligations imposed by applicable laws and regulations.

It is necessary to provide Personal Data for the aforementioned purposes, as refusal would make it impossible to complete the purchase.

Furthermore, with your consent, your Personal Data may be entered into the Roberto Biagini group's CRM program and processed, together with details of your purchases, for the following purposes:

a) Marketing, through traditional means of contact (regular mail and telephone) and/or via email, to send promotional news, commercial communications, newsletters, advertising material, catalogs, and invitations to events organized by the Company.

b) Profiling, and therefore analyzing the user's contacts with the Company, interests, preferences, and purchasing habits. The Company may also use Personal Data to perform statistical and market analyses aimed at identifying products and/or services of interest to customers of its brand.

c) Transfer of Data within the Roberto Biagini group (both within and outside the EU).

The companies of the ROBERTO BIAGINI S.r.l group are present worldwide. Consequently, personal data may be transferred outside the country in which you are located, including to countries both within and outside the European Union ("EU") in order to provide a consistent level of service.

Entering data into the CRM program is optional and free of charge, as it is based on the consent that the user can choose to give when providing their Personal Data for both marketing and profiling purposes (points a) and b)) or only for one of the two. The user may unsubscribe or withdraw their consent at any time (see point 6). Failure to provide Personal Data for one or both of the above CRM purposes does not prevent the user from using the Company's services or making purchases, but the Company will not be able to inform them of marketing initiatives and/or events organized by it and will not be able to understand their interests and offer services tailored to their needs.

The Company also informs you that, if you consent to the processing of your Personal Data for marketing and profiling purposes, as referred to in points a) and b) above, such data will be visible and/or shared with other companies in the Roberto Biagini group (both within and outside the EU), adopting all appropriate and suitable security and confidentiality measures required by the relevant applicable legislation.

4. Communication and dissemination of data

Users can rest assured that their personal data will always be in safe hands, as protecting this data is one of the company's priorities. User information will only be shared in the ways described below and only with third parties who comply with current data protection legislation and ensure an adequate level of data protection. Users' personal data will be shared with the Roberto Biagini group.

The Data may be disclosed to any other third party when disclosure is required by law, including for the prevention/repression of any illegal activity. In all other cases, users' personal data will only be shared with third parties with their prior and explicit consent.

Your Data will not be disclosed in any way. The Data Controller may communicate the Data, solely for the purposes described above, to third parties (e.g., suppliers, partners), duly appointed as Data Processors pursuant to Article 28 of the GDPR. Furthermore, the Data may be communicated to any other party, if such communication is required by law. Finally, the Data may be disclosed to persons authorized for this purpose by the Data Controller.

5. Data transfer

The Personal Data provided by the user, only with their consent, may be transferred to companies belonging to the Roberto Biagini Group located outside the European Economic Area, in accordance with the provisions of applicable legislation, adopting suitable, appropriate, and adequate security measures.

6. Security of personal data

In order to protect users' personal data from unauthorized access, disclosure, and alteration, both technical and other security measures have been implemented. These security measures are periodically adapted in an effort to always offer a high level of security. Nevertheless, users are reminded that, despite all efforts, no security measures are perfect or impenetrable, and therefore the Company cannot be held liable in any way for breaches due to errors, omissions, or unauthorized actions by third parties.

Furthermore, in order to contribute to maintaining a high level of security, users are requested to keep their chosen username and password confidential at all times and not to disclose them to third parties. Some information regarding users will be stored on servers provided by two third parties, currently on an Amazon Web Services server located in Ireland and an eCommerce Outsourcing server located in Milan.

The third-party provider has been selected based on the best knowledge currently available and may be replaced from time to time, especially if there is a belief that users' personal data is no longer adequately protected. The third-party provider constantly strives to provide a high standard of security.

7. Duration of treatment

The Data is acquired and processed by the Company on the basis of your consent, pursuant to Article 6, paragraph 1, letter a) of the Regulation. There is no obligation to provide the Data, but failure to do so will make it impossible for the Data Controller to proceed with the aforementioned activities. Your Data will be stored in accordance with the principle of proportionality and only for as long as necessary for legitimate commercial purposes, or for as long as required by law. We generally store data for a maximum period of 24 months for marketing purposes and 12 months for profiling purposes. At the end of this period, your Data will be anonymized or otherwise stored in aggregate form for statistical purposes relating to consumer choices.

8. User rights regarding processed data

You may modify the data relating to your account at any time by accessing the "Account"area with your credentials.

Furthermore, you may exercise your rights vis-à-vis the Data Controller as set forth in Articles 15 et seq. of the GDPR, including the right to request, at any time, access to the Data, rectification, erasure, or restriction of processing, data portability, as well as the right to object to the processing of your personal data.

Please note that if a user requests the deletion of their personal data, the services offered by the Website can no longer be provided to that user.

You also have the right to modify and/or cancel your subscriptions at any time by using the UNSUBSCRIBE link in the newsletter or other specific procedures that may be made available to you.

We remind you that you can also lodge a complaint with the Data Protection Authority or any other competent supervisory authority.

In the event of substantial changes, we will notify you and request your consent, if required by applicable law.
